This Privacy Statement applies to our website, applications or any other sites hosted by our service providers on our behalf (collectively the “Services”). This Statement describes the information we collect, the purposes for which it is used, and your choices regarding our use of it. By using our Services, you consent to our data practices described in this Statement.

The information that we collect

The personal information that we collect about you can be divided into two categories, personally identifiable information and non-personal data. Personally identifiable information means information that specifically identifies you as an individual. Non-personal data is information that does not identify you.

Personally Identifiable Information
To use our Services, you will be required to text a code to our customer’s phone number. By doing this, you are providing us with your phone number. In some instances, our customers may respond via text message to your phone number using our Services with request for additional information. Our Services store the information you provide to our customers. In these instances, the personally identifiable information that we collect may include:

  • Your legal name, employer, an email address, physical address information, and potentially other personally identifiable information that you voluntarily provide.

We also collect information about you that you provide or through your interactions on the Services. This information includes texts, messages, customer generated content and/or information about your interests in and use of various products, programs, and services. AudienceTap will not collect any personally identifiable information about you unless you provide it to us voluntarily.

Non-Personal Data
We also collect non-personal data through our website that does not identify you, directly, including “automatically collected data,” “aggregated” or “anonymized” information that we collect to inform us how others use our Services. Non-personal data includes, (i) device software platform, operating system, IP address, type of Internet browser, and firmware; (ii) mobile phone carrier; (iii) web browsing patterns, including websites visited and time of access; (iv) geographical data such as zip code, area code, and other non-precise location information; and (v) the way in which you use the Services, including frequency and duration of usage.

Cookies and Similar Technologies
A cookie is a small piece of data sent from a website and stored on the user’s web browser while the user is browsing. Cookies cannot be used to run programs or deliver viruses to your computer, read data from elsewhere on your computer, or misappropriate any personally identifiable information about you. Cookies are uniquely assigned to you, and can only be read by a webserver in the domain that issued you the cookie.

Cookies are useful because they help arrange the content and layout of our websites and recognize authors and administrators who have logged into our sites with a username and password which in turn allows us to recognize those computers or other devices that have been used to visit our website. Cookies serve many purposes, such as allowing our websites to remember your preference settings and helping us to enhance the usability and performance of our websites and your experience using it; for example, a cookie could store your personally identifiable information that you have entered into a form on our Site. We may use cookies that are managed by Alphabet, Inc. (fka Google), which allows us to understand how users navigate to and interact with our Site.

You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of our Site.

Use of your information

We may use your personal information for the following purposes:

Services and Transactions
We may use your personal information to deliver services to you or carry out transactions you have requested, including, but not limited to, providing information on our services or otherwise use, processing transactions, answering customer service requests and facilitating the use of our Services. We may also use your personal information to send you email or postal mail, or provide customer support. We may use the information you provided to contact you directly in order to notify you of updates to the platform, provide you with offers or promotions associated with the platform. As part of delivering services, we may share your information with our customer for whom you initiated contact with by texting to subscribe. We provide these companies with only those elements of your personal information they need to deliver those services. These companies and their employees are prohibited from using that personal information for any other purpose.

Communication among users
AudienceTap uses the information that we collect to enable communications between our customers and users. Our customers, for example, may direct message users that have opted-in to receive text marketing messages on the platform. You are responsible for the information you share with our customers or others.

Improving our Services
We may use your personal information to perform business analyses or for other purposes that help us to develop and improve the quality of our Services; for example, by customizing our Services to your particular preferences or interests.

Compulsory Disclosure
We may also disclose your personal information if we are required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on us; (b) protect and defend our rights or property; or (c) act under exigent circumstances to protect the personal safety of any individual.

Third Party Sites

AudienceTap uses third party service providers to help provide you with the Services. Stripe, Inc. is our third-party payment processor. We do not receive any personally identifiable information about you from Stripe nor do we provide Stripe with any of your Personally Identifiable Information. Your transaction with Stripe is strictly between you and Stripe. Before transacting with us, you should familiarizer yourself with Stripe and their Privacy Policy.

Security of your personal information

AudienceTap is committed to protecting your personal information. AudienceTap uses industry accepted electronic and physical standards of security to reduce the risk of improper access to or manipulation of personally identifiable information during transmission and storage. We employ the use of SSL [Secure Socket Layer] technology is the industry standard and among the best software available today for secure commerce transactions. It encrypts all of your personal information, including name, and address. While we take every precaution to guarantee safety, no method of security is 100% effective and we encourage you to employ discretion when submitting your information.

Your rights to your information

You may have certain rights with respect to personal information about you that is collected through the Services or when you contact us. If you are a resident of the European Union, the rights described below may apply to you. For other users, the rights that apply to you will depend on the laws of your country of residence or, in some instances your state of residence. We will facilitate your exercise of the rights that apply to you in accordance with applicable law.

You may have the right to access, review and correct personal information collected through our Services or when you contact us. In some cases, you can do this by going to the page on which you provided the information. You can help us to maintain the accuracy of your information by notifying us of any change to your mailing address, phone number or e-mail address.

You may be entitled to object to certain types of processing activities involving your personal information, including where we are relying on a legitimate interest to process your personal information or where we are processing your personal information for direct marketing.

You may be entitled to request that we delete your personal information.

You may be entitled to receive and reuse your personal information for your own purposes. This is known as the right to data portability and, where applicable, requires us to move, copy or transfer your personal information from our systems to you or (where technically feasible) a third party chosen by you without affecting its usability.

If you have provided your consent to the processing of your personal information, you may have the right to withdraw your consent at any time by contacting us using the contact details at the end of this Statement or, in the case of email marketing, by using the “unsubscribe” link in any of our marketing emails. This won’t affect the lawfulness of any processing up to that point.

We will respond to any requests from you to exercise your rights within the timeframes required by law. We may charge a fee to facilitate your request where permitted by law. To exercise any of your rights, please contact us using the contact details set out at the end of this Statement. We may take steps to verify your identity before taking action on a request. If you believe our processing of your personal information does not comply with data protection law, you can make a complaint to the supervisory authority in charge of overseeing compliance with data protection law in your jurisdiction. We would however appreciate the chance to address your concerns, so please feel free to contact us regarding any complaint you may have.

Some web browsers may transmit “do-not-track” signals to the Services with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.

Children’s information

We do not knowingly collect information from children and do not target or direct our Services to children. The meaning of “children” is subject to the laws and regulations in the jurisdiction in which you are located.

California privacy statement

Pursuant to Section 1798.83 of the California Civil Code, residents of California can obtain certain information about the types of personal information that companies with whom they have an established business relationship have shared with third parties for direct marketing purposes during the preceding calendar year. The law provides that companies must inform consumers about the categories of personal information that have been shared with third parties, the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. We may occasionally update this Statement to reflect company and customer feedback. When we do, we will revise the "last updated" date at the top and bottom of the Privacy Statement and take such additional steps as may be required by law. AudienceTap California Consumer Privacy Act Privacy Statement

This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS supplements the information contained in the Statement of TextRetailer, Inc. and applies solely to visitors, users, and others who reside in the State of California (“consumers” or “you”) when you visit the Audience website or subscribe to receive the AudienceTap Services (collectively, our “Services”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice.

Information We Collect

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). In particular, we have collected the following categories of personal information from consumers within the last twelve (12) months:

Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records. K. Inferences drawn from other personal information. Profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. NO

Personal information does not include:

  • Publicly available information from government records.
  • De-identified or aggregated consumer information.
  • Information excluded from the CCPA's scope, like:
  • o health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;
  • o personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from our clients or their agents. For example, from information our clients provide to us related to the Services for which they engage us.
  • Directly from you. For example, through information we ask from you when our clients or their agents subscribe and engage our Services.
  • Directly and indirectly from you when using our Services or visiting our website. For example, usage details collected automatically in the course of your interaction with our platform or website.

Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following business purposes:

  • To fulfill or meet the reason for which the information is provided.
  • To provide you with information, products or services that you request from us.
  • To provide you with text alerts, event registrations and other notices concerning our products or services, or events or news, that may be of interest to you.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you, our customers and us.
  • To improve our website and present its contents to you.
  • For testing, research, analysis and product development.
  • As necessary or appropriate to protect the rights, property or safety of us, our clients or others.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • As described to you when collecting your personal information or as otherwise set forth in the CCPA.
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Sharing Personal Information

We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

In the preceding twelve (12) months, we have disclosed the following categories of personal information for a business purpose:

  • Category A: Identifiers.
  • Category B: California Customer Records personal information categories.
  • Category C: We may collect your date of birth if you voluntarily provide it.

We disclose your personal information for a business purpose to the following categories of third parties:

  • Our Customers.
  • Service providers, such as email marketing platforms.

In the preceding twelve (12) months, we have not sold any personal information.

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

  1. Access to Specific Information and Data Portability Rights
  2. You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  4. The categories of sources for the personal information we collected about you.
  5. Our business or commercial purpose for collecting or selling that personal information.
  6. The categories of third parties with whom we share that personal information.
  7. The specific pieces of personal information we collected about you (also called a data portability request).

  11. Deletion Request Rights
  12. You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
  13. We may deny your deletion request if retaining the information is necessary for us or our service providers to:
  14. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  15. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  16. Debug products to identify and repair errors that impair existing intended functionality.
  17. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  18. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  19. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  20. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  21. Comply with a legal obligation.
  22. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
  23. Exercising Access, Data Portability, and Deletion Rights

  27. Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
  28. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
  29. Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  30. Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
  31. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
  32. Response Timing and Format
  33. We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
  34. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
  35. Non-Discrimination
  36. We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
  37. Deny you goods or services.
  38. Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  39. Provide you a different level or quality of goods or services.
  40. Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will notify you by email or through a notice on our website homepage.
